iheartugreetings.com makes available to the User the opportunity to submit greeting card designs for print and sales from this Site.  If you choose to participate, by selecting the “Agreed” button, and in consideration of iheartugreetings.com reviewing your submission (hereinafter the “Design”) for its potential use on a greeting card, you agree to the User Design Terms and Conditions described herein.

If your Design is chosen by iheartugreetings.com for use, you accept and agree to assign to Pinking of You, Inc., iheartugreetings.com and its subsidiaries and affiliates (hereinafter collectively “iheartugreetings.com”) the entire right, title and interest in and to the copyright in your Design, for its sole and exclusive use on and in connection with the greeting cards or other items offered by iheartugreetings.com in the future.  You also agree to waive all “moral” rights that you may have in and to your Design.

If your Design is chosen, iheartugreetings.com may use your Design in any manner for application within the Items, including but not limited to reproduction of the Design on the Items, revising or reworking the Design by changing size, shape or color, making new designs derived from its original submission of Design, selling the Items containing the Design, using the Design on iheartugreetings.com’s or its affiliates’ websites and promotional materials, and registering the Design with the US Copyright Office in the name of Pinking of You, Inc.  You agree to provide iheartugreetings.com with information that may be required in order to register the copyright in the Design if iheartugreetings.com requests so, at no cost to iheartugreetings.com or its affiliates.

You declare that the Design you are submitting and possibly assigning to iheartugreetings.com is your own original work, that it has not been previously published, and that it does not contain any copyrighted material, trademarks, logos, or any other intellectual property belonging to any other party, or any material which iheartugreetings.com in its sole discretion, deems , profane or offensive.

You agree that, if your Design is selected, you may not use the Design or any portion originating from or based on your Design, or allow others to use the Design or any portion originating from or based on your Design, on any item.  Further, you may not reproduce, sell, or submit the Design to others for any commercial use for ninety days after the date of submission to iheartugreetings.com while the Design is being considered for use by iheartugreetings.com.  After ninety days from date of submission of your Design to iheartugreetings.com, if your Design has not been selected for print by iheartugreetings.com, you are no longer bound to the terms described above.  If your Design is used elsewhere, you must notify iheartugreetings.com by email to service@iheartugreetings.com with details of where and when the Design will be or has been used or reproduced so that the Design can be removed from iheartugreetings.com's database.  iheartugreetings.com may choose your design after the ninety days from submission of your Design has elapsed, on the condition that the Design has not been used for commercial purposes elsewhere, as described above.

If your Design is chosen for use by iheartugreetings.com, you will receive $50 in the form of a company check within ninety days from the date you are notified of selection of your Design.  The amount of payment may be changed at any time and changes made will be posted on iheartugreetings.com's website.  Changes are effective at the time the changes are posted to the iheartugreetings.com website.  The amount of the payment is based on the terms in effect upon selection of your Design.  You accept all responsibility and liability of any taxes relative to receiving payment for your Design. 

iheartugreetings.com reserves the right to select or decline a Design submitted for consideration for use for any reason. 

Submissions that, in the opinion of iheartugreetings.com, do not comply with these User Design Terms and Conditions or for any other reason at the discretion of iheartugreetings.com can at any time be excluded from consideration without notice.

Sections related to Design selection by iheartugreetings.com are final and binding.
